Terms of Service for River Streams

Effective Date: April 30, 2025

1. Definitions

• “App” refers to the River Streams mobile application.
• “we,” “us,” or “our” refers to River Streams operated by Mathias Wehler and potential team members.
• “User,” “you,” or “your” refers to any individual or entity accessing or using the App.

2. Acceptance of Terms
By downloading, installing, or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, you must immediately cease all use of the App.

3. License and Access

• 3.1 License Grant. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes.
• 3.2 Restrictions. You shall not:
  • Reverse engineer, decompile, or disassemble the App.
  • Remove, alter, or obscure any proprietary notices on the App.
  • Use the App to infringe any third party’s rights or for unlawful purposes.

4. User Account

• 4.1 Registration. No account or registration is required to use the core features of the App.
• 4.2 User Content. Any content you submit (e.g., feedback) remains your property; however, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display such content in connection with the App.

5. App Content and Availability

• 5.1 Data Sources. The App aggregates real-time river data (water levels, tides, weather, warnings) from third-party providers.
• 5.2 No Guarantee of Availability. We strive for continuous availability but may suspend, withdraw, or restrict access to the App at any time without notice.

6. Updates and Maintenance
We may periodically update or modify the App, including functionality and features. You agree that we have no obligation to provide updates or maintenance, but we may do so at our discretion.

7. Privacy
Your use of data and personal information is governed by our Privacy Policy, which is incorporated by reference. Please review it carefully.

8. Payments and Fees
The App is free to download and use. We may introduce paid features or subscriptions in the future; any such fees will be clearly disclosed within the App.

9. Intellectual Property

• 9.1 Ownership. All rights, title, and interest in the App (including code, design, graphics, and trademarks) are owned by us or our licensors.
• 9.2 Trademarks. “River Streams” and associated logos are trademarks of River Streams Ltd.
• 9.3 Feedback. We welcome your feedback; by submitting feedback, you grant us a perpetual, irrevocable license to use such feedback without compensation.

10. Disclaimers

• 10.1 No Warranty. The App and all content are provided “as is,” without warranties of any kind, express or implied.
• 10.2 Accuracy. We do not guarantee the accuracy, completeness, or timeliness of any data.
• 10.3 Fitness for Purpose. We make no warranty that the App will meet your requirements or be fit for a particular purpose.

11. Limitation of Liability
To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• You agree that our total liability arising from or related to these Terms or the App shall not exceed £10.
• You assume all risks associated with using the App in potentially hazardous environments, including near water, in poor weather, or during navigation activities.
• We are not liable for injuries, losses, or damages (including death or personal injury) resulting from reliance on incorrect data, unsafe use of the App, or third-party service interruptions.

12. Indemnification
You agree to indemnify and hold harmless River Streams. and Mathias Wehler from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the App or breach of these Terms.

13. Termination
We may terminate or suspend your access to the App at any time, with or without cause, and without notice. Upon termination, all provisions of these Terms that by their nature should survive will persist, including disclaimers, limitations of liability, and indemnification.

14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and River Streams Ltd. regarding the App and supersede all prior or contemporaneous communications.
